• These General Terms and Conditions (hereinafter referred to as the "GTC") govern the legal relations based on the contract between the renter and the operator of the www.autickaren.sk website (hereinafter referred to as the "Renter") and the buyer (hereinafter referred to as the "Tenant"), the subject of which is the rental of goods on the www.autickaren.sk website, as the Renter's e-commerce (hereinafter referred to as the "Online Store").
• The contractual relationship is concluded in the form of a binding order confirmed by the Renter, filled in and sent from the online store by the Tenant and is the basis of the contractual relationship, which includes these GTC.
• The subject of the rental are children's electric cars, children's attractions and additional goods intended for children in defined age and weight categories, in good technical condition according to the current offer and availability in the online store.
• Children's electric cars or other electric attractions are rented in working order for one price, including an installed replaceable or permanently installed battery, one charger and remote control, if it is part of the equipment of the rented children's electric car or attraction.
• Additional goods (e.g. spare batteries, chargers and others) are ordered as separate items in the order.
• The Tenant chooses the subject of the rental in the reservation system from the portfolio of children's electric cars, children's attractions and additional goods on the Renter's website
• Subsequently, the potential Tenant fills in all the mandatory fields in the binding order form, which contain invoicing data, the place of use of the subject of the lease.
• By ordering goods from the Renter, the Tenant agrees to these Terms and Conditions by clicking on the box at the end of the order form with the wording "I have read the General Terms and Conditions and agree with them".
• Based on the completed address of delivery and use of the subject of rental, the transport price is filled in.
• The lease is targeted at clients in the Slovak Republic with transport distances of up to 50 km, for longer transport distances from the warehouse in Šamorín, the Reneter is entitled to reject the order due to lack of personnel capacity.
• In the case of personal collection, the Tenant and the Renter agree on the place of handover and takeover of the subject of the lease. In this case, shipping costs are not charged.
• Subsequently, after checking all the completed data, the potential Tenant sends a binding order by confirmation at the end of the form
• After the delivery of the binding order, the Renter will check the order, check the availability of the subject of the lease, operating capacities, or other restrictions. On the basis of verification, the Renter sends the potential Tenant an order confirmation and a request for payment of the rental price in accordance with the order. If restrictions are detected, they are consulted with the potential Tenant (preferably by phone or email). This approval process is handled without delay, no later than within 24 hours.
• The contractual relationship/lease is established upon delivery of a confirmed binding order by the Renter to the Tenant.
• Hand over the leased subject to the Tenant at a pre-agreed time and at the agreed place of handover of the leased subject defined in the order or as agreed.
• Hand over the leased object to the Tenant in an intact condition, clean and without defects that would make it impossible to fully use the leased object, make a record of this in the "Takeover/Return Protocol".
• Familiarize the tenant with the safety rules, train the tenant to operate the subject of the lease and make a record of it in the "Takeover/Return Protocol".
• Write a complete record of the handover of the subject of the lease into the "Protocol of Takeover/Return" and hand over the subject of the lease to the Tenant only after the mutual signing of the protocol.
• To take over the subject of the lease at the agreed time and to make a record of the condition of the subject of the lease in the "Protocol of Takeover/Return".
• In the event of finding defects in the subject of the lease that occurred during the lease by the Tenant, make a record of it in the "Takeover/Return Protocol", quantify the damage incurred.
• A complete record of taking over the subject of the lease "Protocol of Acceptance/Return" should be signed by each other.
• Use the Rental Item solely for its intended purpose and comply with any defined age and maximum load capacity restrictions.
• Comply with all safety instructions defined in these GTC and procedures and rules in accordance with the manual, delivered to the Tenant by e-mail or printed out before taking over the subject of the lease for use.
• To ensure supervision of the operation by an adult and competent person, if the supervision is not carried out by the Tenant in person, to train the person supervising the operation of the subject of the lease with the rules and security measures at least to the extent defined in these GTC.
• To compensate for damage caused by improper use of the subject of the lease.
• Return/hand over the subject of the lease at the agreed time, condition at a pre-agreed place, usually at the place of use of the subject of the lease.
• Follow the instructions for the use of the subject of the lease and the instructions of Renter.
• Only allow the car to be used by a child who meets the manufacturer's age and weight limits.
• Allow driving only under the direct supervision of an adult and only on flat, dry surfaces away from road traffic, slopes, stairs and water bodies.
• Use all safety measures and features that are part of the subject of the rental, in particular ensure that the child is wearing seat belts and sturdy shoes.
• Before each use, check: battery status, brake function, wheel fastening and integrity of seat belts.
• Allow charging only to an adult and competent person, according to the manufacturer's instructions and the Renter's instructions, out of the reach of children and flammable materials, while it is the responsibility of the Tenant to have the possibility (a suitable source) of charging the batteries.
• Ensure that the toy car is not used by a third party without Renter's consent.
• To prevent intentional bumping into obstacles and collisions with each other when renting several cars, because children's electric cars and attractions are not structurally adapted to such manipulation and, in addition to damaging the subject of the rental, there is also a risk of endangering the health of children.
• Protect the car from theft and weather conditions (store in a dry place, at a temperature of 0–40 °C).
• Immediately discontinue use when a defect is detected and inform the Renter.
• The rental period is specified in the order or based on the agreement of the contracting parties
• The handover and takeover of the subject of the lease is within the time windows defined in the reservation system, or exceptionally at another time based on the mutual agreement of the contracting parties.
• The rental period is billed in days. As a rule, it is assumed that the car will be handed over and taken back within the same time window on defined rental days. Examples:
· If the lease is from the 3rd to the 6th day of the month, the subject of the lease will be handed over on the evening of the 3rd, the takeover back will be on the evening of the 6th, the rental is charged for 3 days.
· If the rental is from the 2nd to the 3rd day of the month, the subject of the lease is handed over in the morning of the 2nd and handed over in the evening of the 3rd, 2 days are charged for the rental.
· It is also possible to hand over and take back the rental item on the same day, the rental rate is charged for 1 day.
· Rental from evening to morning is not expected, it can be agreed individually, provided that suitable conditions for operation are created by the Tenant.
• Extension of the lease period is possible only after agreement with the Renter, unless the Renter is prevented from doing so by other facts (another order, etc.)
• The rental price is set in the valid price list or according to individual agreement.
• The Tenant is obliged to pay the price in advance to the Renter's account by bank transfer or on the basis of an individual agreement at the latest upon taking over the subject of the lease
• A fee may be charged for late return of the car according to the price list.
• After payment of the rental price and thus the establishment of a contractual relationship between the Renter and the Tenant, the lease can be cancelled only under the following conditions:
a) Within 7 days of the rental with a refund of 90% of the price paid.
b) Within 2 days of the rental with a refund of 50% of the price paid.
c) Less than 2 days until the rental is completed without the possibility of a refund of the price paid.
d) The price for transport, handover and takeover of the subject of the lease shall be refunded in full in the cases referred to in letters a) and b).
Renter is not liable for damage caused by improper use of the subject of the lease.
Complaints must be reported immediately after discovering defects by phone to the Renter.
Complaints shall be handled by the Renter without undue delay in accordance with the statutory rules.
Renter does not take the risk of worsening weather conditions at his own expense. Deterioration of weather conditions is not accepted as a reason for a complaint or a request for a refund of rent.
Tenant may not make any interventions or modifications to the subject of the lease without the consent of the Renter.
The Lessee bears the risk of intentional destruction, loss or theft of the Subject of Lease and is obliged to pay the Lessor the price of the Subject of Rent in the amount of 15 times the price for renting the Subject of Rent for 1 day.
• The Renter has insurance for compensation for damage caused by the Renter.
• It is recommended that the Tenant conclude an accident insurance policy for children using the subject of the lease and, if necessary, damages associated with damages caused using the subject of the lease.
• For the purposes of concluding the Agreement, the Renter processes the Tenant's personal data only to the extent specified in the Order; in accordance with Article 6(1)(b) of Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons regarding the processing of personal data (GDPR).
• Renter shall not disclose or provide the Tenant's personal data to third parties, with the exception of authorized entities in accordance with the applicable legislation of the Slovak Republic or the European Union and except in cases of waiver of confidentiality pursuant to Section 79 (3) of Act No. 18/2018 Coll. on the Protection of Personal Data and on Amendments to Certain Acts.

• These GTC have been formulated and established in good faith, in order to meet the legal conditions and establish fair relations between the Renter and the Tenant in accordance with the relevant provisions of the applicable legislation of the Slovak Republic.
• These GTC are an integral part of a binding order.
• Renter reserves the right to change these GTC, the current GTC are always available at the time of handing over the subject of the lease.
• Legal relations and conditions are not expressly regulated herein, and any disputes are resolved by the Contracting Parties as a matter of priority by agreement. If no agreement is reached, they will be governed by the relevant provisions of the Civil and Commercial Code and other legal regulations of the Slovak Republic.
The GTC enter into force at the moment of sending a binding order.
